Application to Our Case Froogle is a California corporation with home o ffices in Salinas, California. Froogle’s contract was signed by the defendant and the defendant was well aware of Froogle’s location. Froogle’s software was developed in California and their servers are all located in various parts of California – Froogle is clearly a California product. As the defendant used online transactions through Froogle’s site to set up their account and perform other implementation functions it can be easily argued that this was a California based transaction.Further to this, the defendant benefitted from Froogle’s high profile in California, expanding their customer base throughout the state and thus increasing their sales. The California Code protects Froogle’s right to jurisdiction in California under the â€Å"Long Arm† statute. Although there are rare circumstances where this can be overturned, the statute provides the ability for a California corporation that has entered under a contract or simil ar document with a non-resident partner to gain jurisdiction over that entity should breach of that contract occur. The Snowney case more than implies that if one enters into an agreement with a California entity, and a breach or other violation of the agreement occurs, the parties will more than likely be bringing their action to a California court.The reservation can certainly be interpreted to be a contract as it binds both parties to an obligation and by acceptance of the terms of a reservation, the parties have entered into an agreement or contract. Froogle has the right as a California corporation to file their action in the state of California. The defendant knew it was entering into a contract with a California corporation based out of Salinas, CA. The defendant chose the website due to its power in the retail internet market. It also took advantage of the plaintiff’s website store which brought leads to the defendants store from prospective customers. The defendantâ €™s business benefitted greatly from its presence in the plaintiff’s search engine and webstore. The defendant has no right to jurisdiction in this case and this proceeding should continue in California.

In both â€Å"Dulce et Decorum Est† and â€Å"This is A Dark Time, My Love†, the intimate experiences of the personas give first-hand insights of the terrors and tortures of war. Imagery, pathetic fallacy and language vividly create the ghastly image of war. This is The Dark Time, My Love† is about a people whose dreams of a better life have been threatened by the destructive power of the â€Å"strange invaders. † The persona conveys his intense anger against the British military presence and his belief that their rule is wrong and they display total injustice. Additionally, the persona accentuates the subjection, devastation, death and anger of the people of Guyana. Even nature is sympathetic as â€Å"red flowers bend their heads in awful sorrow. † The poet laments of the misery of his people, the instability of his people and the sorrow brought by these â€Å"strange invaders†. In â€Å"Dulce et Decorum Est†, a soldier vividly describes the horrors of war as he hopelessly watches one of his comrades being â€Å"gassed. † Returning from the battle-field, â€Å"bent double,† coughing and limping with blood-shod feet, they had not heard the gas-filled shells being dropped. Luckily, most of the soldiers managed to escape, but unfortunately one of his comrades did not. As the persona recounts the traumatic experience, he lashes out at all who thinks that it is glorious and honourable to die for one’s country. The impact of the incident on the persona is one of loathing and revulsion. Both poets use imagery which is striking and graphic to inform us of the terrors of war. In â€Å"This is The Dark Time, My Love,† the visual image of the soldiers, â€Å"all around the land brown beetles crawl about†, in their thick armoury is like the beetles who have hard shells on their backs. All around† and â€Å"crawl† creates the image that they move around in large uniform masses, just like beetles. The word â€Å"crawl† also presents the image of the soldiers moving sneakily and invading the land with stealth. â€Å"Who comes walking in the dark night time? / Whose boot of steel tramps down the slender grass† creates the visual image of the soldiers, who can walk through the dark night fearlessly, unaffected by the dark times. An auditory image is also created as the tramping of the soldiers can be heard as they walk on the unthreatening, impotent grass. Imagery in this poem is used to describe the ways in which war oppresses innocent victims, whereas in â€Å"Dulce et Decorum Est†, similes are used to create images of the struggles soldiers face on the battlefield. The simile, â€Å"bent double, like old beggars under sacks†, is vivid as one can actually picture the soldiers â€Å"drunk with fatigue† and trying to make their way back to camp. They are hopeless and tired and though fighting for one’s country is said to be honourable, they are being compared to beggars. This line contrasts with the title of the poem. Both the visual and auditory image of the â€Å"knock-kneed† soldiers â€Å"coughing like hags† shows the choking effect of the smell of the gas. Their coughing sounds like that of an old, tired person, which they in fact are. They cannot breathe and being compared to ‘hags’ emasculates the soldiers. Pathetic fallacy is used in â€Å"This is the Dark Time, My Love† since even nature was in a state of sadness at the oppression of the society. This is seen by the personifications, â€Å"The shining sun is hidden in the sky/Red flowers bend their heads in awful sorrow. The flowers appear to mourn the people in the dark time who are victims of the violence of the soldiers and the suppression by the colonial powers. It seems as if the wilting flowers, whose stems are usually drooping, are actually bending their ‘heads’ in sympathy with those who have to live through the dark times. The â€Å"shining sun† represents hope and prosperity . It is unable to penetrate through the â€Å"dark times† where the people are hopeless and in despair. The sun being hidden in the sky reflects that there is no hope for the society. The emotive and intense language used in â€Å"Dulce et Decorum Est† tells of the anger, revulsion and disgust the persona feels about being part of the war. â€Å"He plunges at me guttering, choking, drowning, â€Å"white eyes writhing in his face† and â€Å"blood come gargling from his froth-corrupted lungs† evokes sympathy in the reader. The soldier’s comrade did not die instantly from inhalation of the gas, he suffered before he died. In all the persona’s â€Å"smothering dreams,† he never thought he would experience anything like that. â€Å"Like a devil’s sick of sin† compares war to the devil who offers no good and will never be sick of sin. War only offers pain and suffering and it is as if those who declare war are in fact devils. â€Å"This is The Dark Time, My Love† and â€Å"Dulce et Decorum Est† both aim to convey the universal message that the stereotypical assumptions about war and fighting for one’s country are lies. Both poems tell of the atrocities of war and that war affects everyone. In â€Å"Dulce et Decorum Est,† the persona remarks that the battlefield is a horrifying experience and that many are scared for life and left feeling helpless and hopeless. The main comment the persona is trying to make is that dying for one’s country is neither noble nor honourable as people claim it to be and those anxious for glory should not buy into this belief. It emphasizes how much they had to suffer and the message received is that war is not worth the trauma and agony they have to endure. In â€Å"This is The dark Time, My Love,† the persona indicates that war is so dehumanising that even nature makes a statement as pathetic fallacy. The persona also refers to war as â€Å"the season of oppression . . and tears. † This alludes to the hostility and brutality to which the Guyanese are subjected and their suffering as a result. War imposes itself on the nation’s culture and robs the nation of its independence and dreams; â€Å"aiming at your dream. † War wreaks severe pain and distress on both soldiers and innocent, targeted people and this brings about the question whether war is really worth the suffering. There is great irony in his words as he can very well afford to do anything he wants, being the very wealthy man and creditor he was. The fact that he states that the matter has nothing to do with his business is very untrue as he would not even be in business were it not for the lower class citizens making him all the money he was accumulating. This dialogue shows that Scrooge is almost feared in society  due to his status and the unkindness that comes with it. Dickens portrays the harsh reality of Scrooge and those of his class early in the novel to cause readers to react and to look forward to seeing how the character changes throughout the novel; thus exemplifying h ow they can change as well. Scrooge destroys any attempt by his nephew to build a relationship with him. He is so preoccupied with his greed for money that he doesnt realize that it is the very thing that is making him miserable. Although Scrooges nephew is poorer than him, he pleads with his uncle saying, I want nothing from you; I ask nothing of  you; why cannot we be friends? (Dickens 43). Dickens illustrates here that people are not even after Scrooge for his money, but merely want him to be open to the idea interpersonal relationships and happiness. Clearly, industry makes the rich richer, however, it also destroys their ability to be truly content with what they have. It makes them ignore the need for human relationships and begins to transform the wealthy into heartless people. The character of Scrooge denies any ties to the community and strives to live for himself alone. The spirits remind Scrooge that he used to be full of joy before he let industry in his way of happiness.  At the thought of the poor dying due to lack of necessities, Scrooge replies, If they would rather dieà ¢Ã¢â€š ¬Ã‚ ¦they had better do it, and decrease the surplus population (Dickens 45). This attitude towards community did not exist before industrialization as people worked together and depended on each other for support. Here, Dickens exemplifies the selfishness that comes along with industry. Dickens mentions the Poor Law and requests for people to recognize the difficulty of those whom the law has put out of place and driven into poverty. He expresses the responsibility that society has to provide for them compassionately. In his novel , Dickens puts forward that this materialistic, cruel society driven by industry can be reformed by becoming a more generous society that values the human life more than material wealth. As he proves with the character of Scrooge, it ultimately results in the joy and success of the society as a whole rather than the depression of the wealthy and the oppression of the poor. Eliot presents her Silas Marner and critiques industrialization similar to the ways in which Dickens opposes it with his novel. She is drawn to the pre-industrial values and attempts to prove that love of others is ultimately more rewarding than love of money. She does this through the character of Silas Marner, who becomes obsessed with the wealth he earns for his work and begins hoarding it, using it as little of it as possible. Just as Dickens does with his description of Scrooge, Eliot describes Marner using physical objects that are incapable of any feeling or emotion: Strangely Marners face and figure shrank and bent themselves into a constant mechanical relation to the objects of his life, so that he produced the same sort of impression as a handle or a crooked tube, which has no meaning standing apart. Eliot uses the characters Godfrey and Dunstan to portray the way in which industrialization and the greed for money can corrupt and break relationships. These two wealthy brothers use each other and others to take advantage of any selfish wish they can claim. Dustan blackmails and bribes Godfrey to accumulate more wealth from him for his own selfish love of gambling and drinking. Godfrey on the other hand, allows his first wife and daughter to suffer due to his ignorance and moral cowardice. Although they have more wealth than most in Raveloe could ever dream of, that craving for an infinite amount of wealth that comes with industrialization corrupts all the relationships these brothers have with others. Dunstan ends up dying without experiencing his saved wealth and Godfrey is left to live a life of regret as he is unable to have children with his second wife and unable to get back his real daughter Eppie. Eliot demonstrates that these relationships are more valuable than wealth but those that ignorant to it, end up losing the relationships. Silas is shown as choosing his relationship to Eppie over his loss of wealth. This however, brings about joy that wealth can never accomplish: Eh, my precious child, the blessing was mine. Life becomes a dark place without any sunshine or the warmth of love, as people become immune and ignorant to such things unless they pull out of the cycle. Eppie, in this case, pulls Silas out of this never-ending cycle into the light, where he can see properly again. The sense of community portrayed in the rural Raveloe is completely opposite to the industrialized place where Silas is originally from. In Raveloes trade-based community, every person plays a vital role in the success of the village. However, Silas and Eppie return to Lantern Yard, he finds that his entire community has vanished and that a large factory has been placed where the chapel one was. This is very significant because the chapel is the place where all different types of people gathered as one community. This sense of community is destroyed by the power of industrialization and completely gets rid of all the tradition, memories, and values the place once held. Eliots Victorian readers would have understood what Eliot was trying to accomplish through her novel. As Victorian society was already experiencing the impacts of industry during the time of the novel, they may have looked upon Raveloe and its sense of community as the image of what they had lost. The industrial landscape that came into existence with the revolution was frightening, destructive, and dehumanizing; destroying all the memories of the better past. Both Dickens A Christmas Carol and Eliots Silas Marner present industrialization as the inevitable leader to the dehumanization of labour, as workers are reduced to nothing more than machines and the amount of money that their work is worth. By presenting these novels to Victorian society, these authors attempted to educate and make aware the tremendous negative effects industry was having on the poors welfare, the happiness of the wealthy, and community bonds as a whole. And so, both authors present the idea that it is better to be like them. By presenting the reformation of Scrooge and Silas, these authors attempt to demonstrate that restoration is possible if people are willing to get out of the cyclical pattern of industrialization and return to the pre-industrial values of society.

After reading the fourth chapter heading of Consider, the first definition of worldview that came to my mind was â€Å"view of the world† just from a literary perspective. The co-authors defined worldview as â€Å"a framework a person brings to decision-making† (Weider & Gutierrez, 2011, p.51). Everyone has a worldview with main characteristics that are ever changing. Different sources influence this framework such as parenting, friendship, telecommunication or internet media, educational and religious sectors. Hindson and Caner (2008) propose standardization methods of worldview are measured either by emotions and feelings, socialism, or the truth (Hindson & Caner, 2008, p.499). Recognition of a person’s worldview can be found based on ones answer to several reality questions surrounding God (origin), human nature (identity), reality (meaning/purpose), after life (destiny), values (morality or ethics). My own definition of worldview is set of beliefs about the most important issues in life and my reaction to it. While in agreement with Jeff Baldwin’s eyeglass concept, I choose to compare my Christian worldview to an internal navigational system. When I am lost and need to be found, Christ is omnipresent. Are these advances as beneficial as most people think? In the novel Brave New World, the author Aldous Huxley, warns readers that scientific advances can be a threat to society. This is particularly evident in the fields of biology, technology and psychology. According to Huxley, "The theme of Brave New World is not the advancement of science as such; it is the advancement of science as it affects human individuals"(Huxley CLC 79 290). One scientific advance of which Huxley warns readers of is that in biology. In the setting of Brave New World, henceforth referred to as the reservation, the mass production of humans is accomplished with the Bokanovsky process.
